Lawful Development

Building work and the use of buildings and land may not have the benefit of planning permission and therefore be unlawful. One way to resolve this situation is to submit an application for a Certificate of Lawful Use or Development. This type of application does not relate to the planning merits of the use or building but concerns factual evidence about the history and planning status of the building, land or use as well as the interpretation of relevant planning law or judicial authority. At Ashley Grantham Smith we are able to prepare and submit applications for clients. In some cases we advise, guide and support applicants through this process where clients prefer to moderate themselves the often time consuming work of collecting evidence.
